1. License Grant

Damm it d.o.o. (“Damm it”) grants you (“Licensee”) a non-exclusive, non-transferable, revocable, perpetual license to install and use the DIIS (Do It In Style) extension (“Extension”) for personal and commercial purposes, in accordance with the terms of this Agreement.

This license is granted on a per-user basis, meaning:

  • You may install and use the Extension on one (1) device at a time.
  • To move the Extension to a different device, you must first uninstall it from your current device before installing it on the new one.
  • Installing or using the Extension on more than one device simultaneously is prohibited.

The license cannot be shared, transferred, or sublicensed to others.

 

2. Permitted Use

  1. Authorized Users:
    The Extension may be used by individuals and businesses in accordance with this EULA.
  2. Prohibited Actions:
    You may not:

    1. Resell, lease, or sublicense the Extension to third parties.
    2. Reverse-engineer, decompile, or disassemble the Extension, except as expressly permitted by applicable law.
    3. Use the Extension for any illegal or unauthorized purpose.

 

3. Intellectual Property

  1. Ownership:
    The DIIS (Do It In Style) extension (“Extension”) and its accompanying documentation (“Documentation”) are copyrighted and protected by copyright laws and international treaty provisions. All rights, titles, and interests in and to the Extension, the Documentation, and all intellectual property rights therein, remain the exclusive property of the Damm it.
  2. No Transfer of Ownership:
    This EULA does not constitute a sale of the Extension or Documentation. You do not receive title to the Extension, Documentation, or any copies thereof, or any intellectual property rights therein.
  3. Protection of Intellectual Property:
    You agree to use your best efforts and take all reasonable steps to protect the Extension and Documentation from unauthorized use, illegal reproduction, or illicit distribution. This includes safeguarding the Extension from infringement, misappropriation, theft, misuse, or unauthorized access.
  4. Definition of Intellectual Property Rights:
    For the purposes of this EULA, “Intellectual Property Rights” means any and all registered and unregistered rights granted, applied for, or otherwise now or hereafter in existence under or related to any patent, copyright, trademark, trade secret, database protection, or other intellectual property rights laws, and all similar or equivalent rights or forms of protection, in any part of the world.
  5. Source Code:
    Under no circumstances are you entitled to access, use, or obtain any copies of the source code for the Extension. Damm it is not obligated to disclose, provide in escrow, or otherwise make available the source code to you or any third party.
  6. Third-Party Components:
    The Extension includes the following third-party components, each governed by its respective license agreement:

By using the Extension, you acknowledge and agree to comply with the licensing terms of these third-party components. Damm it is not responsible for any changes to these third-party licenses.

 

4. Updates and Support

  1. Updates:
    Damm it may provide free updates and patches for the Extension within the same version. Updates for major version changes (if any) may be subject to additional terms or fees.
  2. Support:
    Limited customer support is available through:

    1. A dedicated Discord channel for DIIS issues.
    2. Email support at diis@dammit.tv.
      Damm it does not guarantee resolution of issues or response times due to limited resources.

 

5. Other Restrictions

  1. Compliance with License Terms:
    You shall use the DIIS (Do It In Style) extension (“Extension”) and its accompanying documentation (“Documentation”) strictly in accordance with the terms of this EULA. You may not use (including making copies of) the Extension or Documentation beyond the scope of the license granted under Section 2.
  2. No Modification or Derivative Works:
    You shall not alter, adapt, modify, translate, port, or create derivative works of the Extension or Documentation or any part thereof. Any modifications, improvements, enhancements, alterations, customizations, or derivative works of the Extension, whether authorized or not, made by you or a third party shall be the sole and exclusive property of Damm it, and you hereby assign all of your rights, titles, and interests therein to Damm it.
  3. No Unauthorized Copying:
    You shall not copy the Extension or Documentation, in whole or in part.
  4. No Commercial Exploitation:
    You are expressly prohibited from selling, renting, leasing, lending, sublicensing, assigning, distributing, publishing, transferring, outsourcing, setting up a B2B hub, or using in a service bureau environment, or otherwise commercially exploiting the Extension and/or Documentation in any way.
  5. Protection of Intellectual Property Notices:
    You will not remove, delete, obscure, or alter any trademark, logo, copyright, patent, or other intellectual property or proprietary notices, legends, symbols, or labels in the Extension and/or Documentation, including any copy thereof.
  6. No Benchmarking or Competitive Analysis:
    1. You are not authorized to use the Extension for comparison with, or benchmarking against, similar extension.
    2. You will not disclose or publish any results of benchmark tests run on the Extension to a third party without Damm it’s prior written consent.
    3. You shall not use the Extension or Documentation for purposes of competitive analysis of the Extension, the development of a competing extension product or service, or any other purpose that is to Damm it’s commercial disadvantage.
  7. No Source Code Access:
    Notwithstanding anything to the contrary in this EULA, there will be no escrow of any source code of the Extension, and you shall not be entitled to receive the source code for any reason.
  8. Compliance with Laws:
    You shall not use the Extension or Documentation in violation of any law, regulation, or rule.
  9. Open Source Extension Restrictions:
    You may not combine or distribute the Extension or any derivative work thereof with Open Source Extension (as defined in Section 1) or with extension developed using Open Source Extension (e.g., tools) in a manner that subjects Damm it or its licensors, or any portion of the Extension provided by Damm it. or its licensors hereunder, or any derivative work thereof, to any license obligations of such Open Source Extension.
  10. General Restrictions:
    You further agree not to use the Extension in violation of any restrictions in this EULA or any applicable ordering terms.

 

6. Warranty and Disclaimer

The extension and documentation are provided “as is” and with all faults and defects without condition or warranty of any kind. The entire risk as to satisfactory quality, performance, accuracy, and effort is with you. There is no warranty against interference with your enjoyment or against infringement with respect to the extension and documentation. There is no warranty that the extension or the documentation will fulfill any of your particular purposes or needs.

There is no implied warranty of benefit for the ordinary purposes to which such extension or documentation are used. There is no warranty, representation, or guarantee that the extension will continuously operate or be error-free or that any problems will be corrected. Should the extension or any of its components prove defective or inadequate in any respect, you (and not Damm it or its affiliates or representatives) assume the entire cost of all necessary servicing, repair, or correction.

Further, Damm it does not warrant, guarantee, or make any representations regarding the use of, or the results of the use of, the extension in terms of its ability to deter unauthorized access, its compatibility with hardware or other extension, its reliability, currentness, or otherwise. You rely on the extension and its performance solely at your own risk.

Any and all other representations and warranties, including but not limited to any implied warranties of merchantability and/or fitness for a particular use or purpose, quality, course of dealings, usage of trade, inaccuracy in content caused by Damm it’s failure to perform with reasonable care, quiet enjoyment, or non-infringement, are hereby expressly disclaimed.

Damm it is not liable for delays, interruptions, service failures, and other problems inherent in the use of the internet and electronic communications or other systems outside the reasonable control of Damm it.

 

7. Limitation of Liability

Notwithstanding any damages that you might incur, the entire liability of Damm it. and any of its suppliers under any provision of this EULA, and your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by you for the extension.

To the maximum extent permitted by applicable law, in no event shall Damm it or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, or loss of privacy) arising out of or in any way related to the use of or inability to use the extension, third-party extension, and/or third-party hardware used with the extension, or otherwise in connection with any provision of this EULA, even if Damm it or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

 

8. Termination

  1. This EULA may be terminated as follows:
    a. By you, at any time and for any reason, provided you delete the extension and all copies thereof from your computer(s).
    b. By Damm it, at any time and for any reason, upon sixty (60) days written notice to you.
    c. By Damm it, automatically and without notice, if:
    i. You fail to comply with any term or condition of this EULA;
    ii. Any separate agreement between you and Damm it is terminated for any reason.
    d. If either party goes into receivership, bankruptcy, or insolvency, or makes an assignment for the benefit of creditors, or ceases business operations, this EULA shall be immediately terminable by the other party by written notice, but without prejudice to any rights of the terminating party hereunder.
  2. Effect of Termination:
    Upon termination of this EULA:
  1. You must cease all use of the extension.
  2. The extension will automatically deactivate, as the license is validated locally every 30 days. If the license is no longer valid, you will no longer be able to use the extension.
  3. You must delete all copies of the extension from your computer(s).
  1. Survival of Rights:
    Termination of this EULA will not limit any of Damm it’s rights or remedies at law or in equity in case of breach by you of any of your obligations under this EULA.

 

9. Legal and Compliance

  1. Governing Law:
    This EULA is governed by and constructed in accordance with the laws of the Republic of Croatia, which is part of the European Union. Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the competent court in Zagreb, Croatia.
  2. GDPR Compliance:
    Damm it is committed to complying with the General Data Protection Regulation (GDPR) and other applicable data protection laws.
  3. No Data Collection: The extension does not collect, store, or process any personal data by default.
  4. Voluntary Bug Reports: If you choose to submit a bug report and include your email address, your email will be used solely for the purpose of responding to your report. By providing your email, you consent to its use for this purpose.
  5. Data Retention: Any email addresses provided in bug reports will be retained only for as long as necessary to address the issue and will not be used for marketing or other purposes without your explicit consent.
  6. Your Rights: Under GDPR, you have the right to access, correct, or delete any personal data we hold about you. To exercise these rights, please contact us at diis@dammit.tv.
  7. Anonymous Feature Usage Tracking: To improve the Extension and prioritize feature development, DIIS collects anonymous usage statistics related to feature interactions. No personally identifiable information (PII) is collected, stored, or processed.
    Since this data is fully anonymized and does not fall under personal data regulations such as GDPR, there is currently no opt-out mechanism. However, we ensure that no user data can be linked back to an individual, and all collected data is strictly used to enhance the user experience.
  8. License Verification Data: When verifying a license through Gumroad, our extension temporarily receives information from Gumroad’s API, which may include personal data such as the purchaser’s email and name. This data is used solely for license verification and is not stored or processed beyond the verification step.

 

10. Additional Clauses

  1. Entire Agreement:
    This EULA constitutes the entire agreement between you and Damm it regarding the use of the extension and supersedes all prior or contemporaneous understandings, agreements, or representations, whether oral or written.
  2. Severability:
    If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  3. Assignment:
    You may not assign or transfer your rights or obligations under this EULA without the prior written consent of Damm it.
  4. Waiver:
    The failure of Damm it to enforce any provision of this EULA shall not constitute a waiver of its right to enforce such provision in the future.
  5. Dispute Resolution:
    Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the Commercial Court of Zagreb, Croatia (or another appropriate court in Croatia, depending on the nature of the dispute).
  6. Force Majeure:
    Damm it shall not be liable for any failure or delay in performance of its obligations under this EULA due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government restrictions, or failures of third-party services. In such cases, Damm it will make reasonable efforts to notify you and resume performance as soon as practicable.
